Terms and Conditions
Please note: Tools That Last Pty Ltd ATF TTL Trust, herein referred to as “TTL”.
All prices and quotations are subject to change without notice. Orders are accepted on the basis that they will be invoiced at the prices and terms in effect at the time of shipment. All wholesale product prices are quoted per unit and excluding GST.
RESERVATION OF TITLE
The ownership of goods purchased from TTL does not pass to the purchaser until payment has been received in full. TTL reserves the right to have goods removed from the store if payment is not made within terms agreed, or in the event of the business closing down or ceasing trade for any reason.
Product specifications quoted are approximate and subject to commercial tolerances. Specifications are subject to change without notice.
MINIMUM ORDER & FREIGHT TERMS
Victoria: Orders over $150.00 excluding GST are delivered Free In Store (FIS). Orders less than $150.00 will be subject to a minimum freight charge of $15 depending on size and weight of products ordered.
NSW, ACT, SA, Tas: Orders over $200.00 excluding GST are delivered FIS. Orders less than $200.00 will be subject to a minimum freight charge of $15 depending on size and weight of products ordered.
Qld, NT, WA: Orders over $250.00 excluding GST are delivered FIS. Orders less than $250.00 will be subject to a minimum freight charge of $20 depending on size and weight of products ordered.
All products are guaranteed to be free of defects in manufacture and materials for a period of 12 months from date of invoice. Products are not guaranteed against misuse, abuse, improper use, modification, neglect, negligence or wear and tear. TTL reserves the right to reject a warranty claim if the product shows signs of improper use (as noted above) on receipt of valid warranty claim. TTL will, at their own discretion, re-supply equivalent product, repair the product or credit the customer account to the value of the original purchase price.
Head office must be contacted before any goods are returned and authorisation provided with a valid reference number. Under certain circumstances, a re-stocking fee may apply, calculated at 15% of the original sales invoice value. TTL will not accept returns of discontinued or obsolete products, or products not in original saleable condition including packaging. Claims for damaged stock must be made in writing and the goods returned to us, or collected by a Tools That Last representative within 14 days of receipt of goods.
All accounts are strictly 30 days End Of Month (EOM). In the event that invoices are paid outside these terms, at the discretion of TTL, settlement terms will be revised to prepaid. In the event that an invoice becomes 60+ days overdue, the account will be sent to a debt-collector at the customers’ expense. An intermediate invoice of $85 plus GST will be charged to cover the costs of filing the debt. All other costs incurred with the debt collection will be invoiced to the customer.
DISCOUNT ITEM PRICING
Discounts given on particular items at the time of sale will not apply if payment is made outside our trading terms of 30 days EOM.
SHORT DELIVERY CLAIMS
Claims for short delivery are to be made within 5 working days of receipt of goods. Upon acceptance of a claim for short delivery, TTL reserves the right to either credit the customer account or provide replacement goods.
MATTERS BEYOND OUR CONTROL
TTL will not be liable for loss of income due to any warranty claims, short-supply, delayed delivery or other matters beyond our control.
Images within our catalogue and website are photographs taken of the exact stock held in the warehouse at the time of producing the catalogue and website. TTL will not be held accountable for any changes in product colour, packaging, or change of design. Any changes to product colour, packaging or design may change without notice. All images remain the property of TTL and must not be copied or reproduced.
OUT OF STOCK ITEMS
TTL will hold backorders upon request for out of stock items. If an item is out of stock, it will not be invoiced to the customer until sent on a separate invoice.
MISPRINTS OR ERRORS
Whilst every effort is in place to make sure there are no errors within the catalogue or website, TTL reserves the right to correct details, including product information and prices, if errors are found.
